The Verkhovna Rada of Ukraine has registered bill No. 10448, which allows the use of reproductive cells of deceased military personnel for the continuation of their lineage. Bill No. 10448, registered on January 31, 2024, provides that the reproductive cells of deceased Ukrainian military personnel will not be disposed of, but can be used for the continuation of their lineage. This bill amends the previously adopted Ukrainian law in November 2023. The previous version of the law implied the disposal of reproductive cells of military personnel who died or were declared deceased.
A child born using such cells is considered the child of the deceased military personnel and is entitled to benefits. This is an important step in protecting the rights and freedoms of deceased military personnel and their families.
Both military personnel who have preserved their reproductive cells and their relatives who have permission to use these cells can avail themselves of this service. The bill applies only to military personnel who died or were declared deceased as a result of Russian aggression.
The procedure for filling out a prescription for the use of reproductive cells includes their written approval and notarization. The final form of this procedure will be determined by the Government after the bill is passed by the Verkhovna Rada of Ukraine.
To establish paternity of a child born after the death of a defender, a court ruling on paternity is required. After paternity is established, children are entitled to benefits provided by the legislation for the children of deceased defenders of Ukraine.
